Exciting things continue to happen here at CABO, and I’m happy to share some recent successes with you.  Our membership continues to grow, so don’t forget about CABO cash available to those who refer new members.  The National Gay and Lesbian Chamber of Commerce event at Foxwoods was a success, and we’re looking forward even more to the National Business & Leadership Conference August 1-5 in Las Vegas.  Our 2012 member directory is in the works, which is a great opportunity to get your message out to business across the state.  Make sure you also check out the new features we’ve added to www.thecabo.org.  Our website is a great way to keep updated on CABO events and the benefits of your membership.  Finally, we’re seeing even more interest in the NGLCC Supplier Diversity program.  This program is a huge benefit of belonging to CABO and can help your business create partnerships with businesses large and small.  You can read more about these opportunities in this issue.

Join us in Vegas for the National Business & Leadership Conference

The National Gay & Lesbian Chamber of commerce sponsors a national conference every year.  This is a great event for networking, leadership development, professional advancement, and advocacy.  In fact, CABO owes its founding to this event since it was after such a conference that Dena Castricone returned to Connecticut with the idea for creating a local organization to provide greater opportunities for the GLBT business community.  This year’s event promises to be better than ever, with speakers including Suze Orman, Senator Harry Reid, and more.  It is August 2-5 at the Planet Hollywood Resort & Casino in Las Vegas.  Planet Hollywood is offering a special rate of $99 per night through July 1 and the event registration starts as low as $299 for the entire event.  Don’t delay signing up for these early discounts!

Take Advantage of the New Small Business Tax Credit

What it is

As you may know, small group employers may qualify for a tax credit that could help them save on health benefits for their employees. Companies with 10 or fewer full-time employees making an average of $25,000 or less will see the biggest cost savings. The new and revised information to apply for the tax credit is available on the IRS.gov website.

What it means

  • Companies that could not previously afford to offer health benefits may now be able to.
  • Other companies may now be able to maintain the health benefits coverage they have.
  • Or businesses may now be able to offer employees a more comprehensive health benefits plan.

On July 2, Foxwoods celebrates 25 years of bingo with its wildly popular Firecracker Bingo event. In celebration of the game that has helped launch Foxwoods into the extensive property it is today, these high stakes games feature an astounding $1 million jackpot, a multitude of prizes including $100,000 in cash door prizes and a 2011 Chevrolet Corvette valued at more than $73,000.

For anyone who has ever imagined becoming their favorite performer, “Legends in Concert” takes that dream to the stage as the highly anticipated celebrity tribute show begins July 1 and runs through September 4 at Fox Theater. Audience members will feast their eyes on spectacular performers including Michael Jackson, Britney Spears, Elvis, Cher, Liberace, Donna Summer, Celine Dion, The Beatles, Carrie Underwood, and Frank Sinatra. Catch an exciting show at Fox Theater on Sundays at 4 p.m.; Mondays at 8 p.m.;  Wednesdays through Saturdays at 8 p.m.; and Wednesday matinees 1 p.m. Tickets are general admission and only $30.

MGM Pool Party

Foxwoods’  second annual“Liquid Sundays,” an adult poolside party offered every Sunday afternoon during the summer from 12 noon to 6 p.m., includes a number of celebrity appearances such as Idris Elba (July 3), Kendra Wilkinson (July 31), and Funkmaster Flex (August 7). Guests must be 21+ to attend and cover charge is $20. And don’t miss “First Fridays,” a nighttime outdoor party taking place on select Fridays in the summer at the MGM Grand pool from 8 p.m. to midnight. Celebrity hosts include talk show host and “Dancing With The Stars” contestant Wendy Williams on July 1 and Snoop Dogg will come “drop it like it’s hot” on September 2. Cover charge is $25 (July 1) and $50 (September 2). Guests must be 21+, and the First Fridays will move inside during inclement weather.

As part of its Summer program, Foxwoods is also offering free concerts for Dream Card holders on Tuesday nights, dubbed “Free Tunes Tuesdays.” Be sure to check out these upcoming acts appearing on Tuesdays at 7 p.m. at the MGM Grand Theater: Foghat (July 5); Court Yard Hounds (July 12); Kool & The Gang (July 19); Salt-N-Peppa with SVW(July 26); Musiq Soulchild (August 2); The Bacon Brothers Band (August 9); and the Spin Doctors (August 23).

July 10 through 16, a collection of Foxwoods’ finest eateries celebrate restaurant week with prix-fixed menu specials each night. Restaurants include Al Dente, Alta Strada, Cedars Steak House, Craftsteak, David Burke Prime, Golden Dragon, High Rollers, Paragon, Scorpion Bar and Shrine. And don’t miss Foxwoods’ renowned Executive Chef Duane Owen and his culinary team as they showcase daily chef demonstrations on the promotional stage.
 
Foodies rejoice with Foxwoods’ summer food festivals offering the ultimate taste of summer with “Summer Seafood” (July 30 & 31, 12 p.m. – 8 p.m.) and “Backyard BBQ” (August 20 & 21, 12 p.m. – 8 p.m.). Guests will enjoy New England’s freshest seafood and mouth-watering BBQ during these events at the Premier Ballroom at MGM Grand at Foxwoods.  Admission is free with Dream Card; food and beverage tickets are $1 with most items ranging from 1 to 4 tickets.

Labor & Employment Update: New Regulations Clarify Requirements Under the Americans with Disabilities Act Amendments Act.

What Employers Need to Know

The first President Bush signed the original Americans with Disabilities Act ("ADA") into law in 1991. Seventeen years later the second President Bush signed the ADA Amendments Act ("ADAAA"), which made several significant pro-employee changes to the law that cancel out pro-employer interpretations of the ADA developed by a series of Supreme Court decisions. On March 25, 2011, the Equal Employment Opportunity Commission ("EEOC") issued final Regulations and Guidance under the ADAAA. These Regulations become effective on May 24, 2011. While most employers are likely aware of the changes to the law, the current regulations should serve as a catalyst for educating your management team on compliance.

As the new Regulations strongly emphasize, Congress mandated that the ADAAA shall be construed to be in favor of broad coverage to the maximum extent permitted by the terms of the statute, and that the determination of whether an individual has a disability should not demand extensive analysis. The Regulations state: "The primary object of attention in cases brought under the ADA should be whether covered entities have complied with their obligations and whether discrimination has occurred, not whether the individual meets the definition of disability." (Emphasis in Regs.) The Regulations quote from the legislative history of the ADAAA as follows:

"[L]ower court cases have too often turned solely on the question of whether the plaintiff is an individual with a disability rather than the merits of the discrimination claims, such as whether adverse decisions were impermissibly made by the employer on the basis of disability, reasonable accommodation were denied, or qualifications standards were unlawfully discriminatory." While Congress and the EEOC do not quite "put the cart before the horse", and the statute and the Regulations still acknowledge the need for an individual assessment in each case, employers should be wary of denying an accommodation to, or discriminating against, an employee with any type of physical or mental impairment on the basis that the employee is not "disabled". This year, The Rainbow Times has been the main media partner of three major New England Pride Organizations.
